RESOLUTION NO. 01-2

AMENDED PARKING RESOLUTION

WHEREAS, Section 5.11 of the By-Laws states that the Board of Trustees shall have and exercise all lawful powers and duties necessary for the property conduct and administration of a residential condominium project and may do or cause to be done all such other lawful acts and things as are required to done or exercised by members of the Association or unit owners, or by others; and

WHEREAS, Article 4.11 of the By-Laws permits the Board of Trustees to adopt reasonable rules and regulations which shall be in addition to and supplement the restrictions on the owners' use of the Common Elements as long as such Rules and Regulations are consistent with other governing documents of the Association; and

WHEREAS, Article 4.11 of the By-Laws requires each Member to comply strictly with the By-Laws and Administrative Rules and Regulations adopted pursuant thereto as either may be amended lawfully from time to time; and

WHEREAS, Article 5.11 (X) specifically gives the Board the authority to adopt rules and regulations regarding the use of all parking spaces, including the type, size and classification of vehicles permitted to use any space as well as the total number of vehicles which may be parked on the common elements on a permanent basis per unit; and

WHEREAS, the Board deems it necessary and desirable to establish certain general rules and regulations regarding the towing of any vehicles improperly parked on Society Hill premises;

NOW, THEREFORE, BE IT RESOLVED that the following Rules and Regulations be and are hereby adopted:

1.         Any illegal cars located on the premises, including but not limited to commercial vehicles, unregistered vehicles and vehicles without proper license plates, will be towed off the site to the tow contractor's storage facility.

2.         Any other vehicle improperly parked on Society Hill property including but not limited to the following:

1.   Vehicle parked in someone's assigned parking space;

2.   Vehicle parked within 10 feet of a fire hydrant;

3.   Vehicle impeding snow removal efforts;

4.   Vehicle blocking flow of traffic by being parked on the side of roadway more than three feet from the curb, not in a space, or parked within 15 feet of an intersection;

5.   Vehicle parked in any area other than in a designated parking space, including but not limited to lawn areas or sidewalks, shall be towed off the site to the tow Contractor's storage facility.

3.         The owner of the improperly or illegally parked vehicle shall be responsible for the payment of all costs associated with the towing of the vehicle from the site including any storage fees imposed by the towing contractor.

4.         This resolution shall not limit any other rights which the Association may legally have against the owner of the vehicle.

5.         To the extent that this Resolution modifies the language of the Resolution dated July 17, 1995, then the language of this Resolution shall control.

11-18.5                                    TOWNSHIP OF PISCATAWAY

 

            11-18.5  Society Hill at Piscataway

 

            a. The provisions of Subtitle One, Title 39 of the Revised Statutes of New Jersey, shall be made applicable to the semi-public roads, streets, driveways and parking lots at the Society Hill at Piscataway located in the Township of Piscataway, County of Middlesex.

 

            b. All vehicles must park only in designated areas and between the lines provided.

 

            c. Handicapped Parking. All stalls shall be 12 feet wide as shown on the site plan on file with the township clerk and signed with R7-8 (reserved parking sign and penalty plate) in the designated parking areas for persons who have been issued the handicapped parking permits by the Division of Motor Vehicles.

 

            d. Through Streets. The following street or parts of streets are hereby designated as through streets. Stop signs shall be installed on the near right side of each street intersecting the through street except where yield signs have been provided for in the designation:

            e. Stop Intersections. The following intersections are hereby designated as stop intersections. Stop signs shall be installed as provided therein:

            2. Road A (both intersects) and Lancaster Court           Road A (both intersects)

            f. Speed Limits.

 

            1. The speed limits for both directions of traffic in the parking lots shall be 15 m.p.h.

            2. The speed limits for both directions of travel on the following roads are:

            3. Regulatory and warning signs shall be erected and maintained to effect the above designated speed limits authorized by the Department of Transportation.

 

            g. Tow-away. Any vehicle parked or standing as to obstruct or impede a normal flow of traffic, block entrances or exit ways, loading zones, oil fills, any grass area, pedestrian walkway, or present in any way a safety or traffic hazard may be removed by towing the vehicle at the owner’s or operator’s expense.
