POLICY RESOLUTION NO. ______

 

PERTAINING TO INSTALLATION OF SATELLITE DISHES AND/OR OTHER ANTENNAS

 

WHEREAS, the By-Laws of the Association (the "By-Laws") provide that the affairs of the Association shall be governed by a Board of Trustees; and

WHEREAS, the By-Laws state that the Board of Trustees shall have powers granted to it by the Certificate of Incorporation, the Master Deed, by By-Laws or by law; and

WHEREAS, the Association is authorized to adopt and enforce reasonable rules and regulations in the interests of the Association; and

WHEREAS, the Board of Trustees has determined that members of the Association should be entitled to install satellite dish antennas and/or certain other antennas with limitations and desires and intends to adopt reasonable restrictions governing installation, maintenance, and use of satellite dishes and/or other antennas in the best interests of the Association and consistent with Federal Communications Commission rules and regulations and other applicable law.

NOW, THEREFORE, BT IT RESOLVED THAT:

1.         The Rules for the Installation of Satellite Dish Antennas and/or Other Antennas related to common areas are hereby adopted by the Association:

            a.         No satellite dish antenna or other type of antenna shall be installed on the common areas without prior approval by the Board of Trustees.

            b.         Common areas include, but are not limited to roofs, chimney chases, exterior siding, and certain grassy areas and planting beds.

            c.         Satellite dishes may be installed on common areas, only if:

                        (1)        The Association gives prior written approval for the installation; and

                        (2)        The unit owner is unable to obtain a proper signal by installing the satellite dish on the exclusive use limited common property; and

                        (3)        The satellite dish antenna does not exceed one (1) meter in diameter.

                        (4)        In the event of a roof replacement/repair requiring that the satellite dish or antenna be removed, the unit owner shall be solely responsible for removing the satellite dish or antenna and shall be responsible for the replacement of same including all costs associated therewith.

2.         The Rules for the Installation of Satellite Dish Antennas and/or Other Antennas related to certain exclusive use limited common areas are hereby adopted by the Association:

            a.         The Association shall not prohibit unit owners from installing satellite dishes on certain exclusive use limited common areas, nor require any reasonable cost or delay associated with such installation.

            b.         Limited common elements include, but are not limited to, patios, decks, and balconies which are set aside for the exclusive use of the unit owner.

            c.         No satellite dish antenna shall exceed one (1) meter in diameter.

            d.         Subsequent to installation, the unit owner shall provide the Association with the location of the satellite dish antenna.

3.         All unit owners must, at all times, comply with all provisions of these rules.

4.         Notwithstanding anything elsewhere herein or in the rules, owners may install certain antennas on certain exclusive use limited common property without formal approval to the extent permitted by the rules.

5.         Any satellite dishes and/or antennas that were installed under the Association's prior satellite dish policy (with the Board's permission) shall be grandfathered into this new policy. However, any satellite dish and/or antenna with was installed without the approval of the Board under either the prior satellite dish policy or the present satellite dish policy shall be subject to the Association's enforcement regulations as allowable under the Association's Master Deed, By-Laws, and/or by law.
