RESOLUTION NO. 03-3
RESOLUTION REGARDING PROTOCOL FOR REPAIR OF CONDOMINIUM
UNITS IN EMERGENCY SITUATIONS
WHEREAS, the Board of Trustees of Society Hill at Piscataway Condominium Association, Inc. is desirous of establishing a consistent policy pertaining to the repair of condominium units suffering damage as a result of water leaks and other emergency situations; and
WHEREAS, the Board of Trustees is concerned regarding the amount of reimbursements to be paid to unit owners for any repairs which are contracted for or performed by unit owners in such situations; and
WHEREAS, the Board of Trustees is of the opinion that in many instances its on-site maintenance company can perform necessary repairs at a cost lower than that incurred by the individual unit owners, including on occasion, work which may be deemed part of the monthly Maintenance Contract; and
WHEREAS, the Board of Trustees believes it is desirable for all unit owners to be aware of the need to avoid unnecessary expenditures of funds for repair to individual condominium units and/or common elements of Society Hill;
NOW, THEREFORE, BE IT RESOLVED as follows:
1. In the event that a unit owner incurs damage to his/her condominium units as a result of a water leak and/or other emergency situation, for which the unit owner believes that the Association may have some responsibility, the unit owner shall attempt to contact the management company for Society Hill, either at the Management Office or the emergency number so provided.
2. In the event that the unit owner cannot contact the management company or the management company cannot respond in a reasonable timely manner as a result of which the unit owner and/or Association will incur additional damage to said property, then the unit owner may contact a contractor of his/her choice in order to effectuate the necessary repairs.
3. Any unit owner seeking reimbursement from the Association for expenses incurred as a result of the necessary repairs shall provide a copy of all repair bills to the management company for Society Hill in a timely manner.
4. The unit owner shall only be entitled to reimbursement for those bills which are incurred for the necessary repairs of the condominium unit, and will not include the cost of any upgrades and additional cosmetic repairs. Furthermore, the Association will only be obligated to reimburse the unit owner for those repairs for which it is lawfully obligated to provide under the terms and provisions of the By-Laws, Master Deed or other governing documents of the Association.
