RESOLUTION NO. 03-1 (REVISED)

RESOLUTION REQUIRING UNIT OWNERS TO REPLACE WASHING MACHINE

HOSES AND ORIGINAL HOT WATER HEATERS

 

WHEREAS, the Board of Trustees of Society Hill at Piscataway Condominium Association, Inc. has been advised by its insurance agent as to significant difficulties in obtaining a blanket condominium insurance policy for the Society Hill premises for the year 2003; and

WHEREAS, the Board of Trustees has been advised that one of the reasons for the difficulty in obtaining such insurance arises as a result of the significant number of claims made for damage in the recent past; and

WHEREAS, several of the aforementioned claims arose as a result of water leaks involving washing machines hoses and/or faulty hot water heaters; and

WHEREAS, the Board of Trustees is aware that, due to the age of the Society

Hill complex, several washing machine hoses and/or hot water heaters may have reached their maximum life expectancy; and

WHEREAS, the insurance agent for Society Hill has advised the Board of Trustees that replacement of washing machine hoses and/or hot water heaters could assist the Association in its efforts to obtain a blanket insurance policy at a more affordable level;

NOW, THEREFORE, BE IT RESOLVED as follows:

1. Annually, and upon ten (10) business days notice, each owner shall allow the inspector selected by the Association to inspect any water heater and washing machine hose that serves the unit in order to determine said water heater's suitability for further service.

2. Within thirty (30) days of a determination, by the inspector referred to in the preceding paragraph, that any water heater is unsuitable for further service, the affected owner shall purchase and shall have installed a replacement water heater. The owner shall send the Association proof of purchase and installation of the water heater.

3. The replacement water heater must be: at least forty (40) gallons or greater capacity; installed by a qualified person; and guaranteed against failure for a period of not less than eight (8) years.

4. In addition to the above, each unit owner agrees to install a Floodchek washing machine hose to service any washing machine located in his/her condominium unit.

5. Failure to comply with the terms of this Resolution will result in a fine of Fifty Dollars ($50.00) per month assessed against the owner for each full, calendar month of noncompliance from the date referred to in either Paragraph 1 or 2, immediately above, as either may apply.

6. For any unit owner who fails to comply with the terms and conditions of this Resolution, and fails to make the necessary arrangements for replacement of washing machines hoses and hot water heaters, the Association specifically reserves the right, at its sole discretion, to make arrangements for such work to be performed and any costs incurred by the Association for the aforesaid work shall be assessed to the unit owner where such work is performed.
