RESOLUTION NO. 97-1
DRYER VENT/FIREPLACE RESOLUTION
WHEREAS, the Board of Trustees of Society Hill at Piscataway Condominium Association Inc. is concerned regarding the safety of the members of the Association; and
WHEREAS, the Board is of the opinion that proper maintenance of units includes a periodic inspection/cleaning of the dryer vents servicing each unit as well as the fireplace flues in those units which contain fireplaces; and
WHEREAS, Pursuant to the By-Laws and Master Deed of the Association, each unit owner is responsible for the maintenance and upkeep of the limited common elements servicing his/her respective unit; and
WHEREAS, The dryer vents and fireplace flues servicing a particular unit constitute part of the limited common elements for which the unit owner is responsible; and
WHEREAS, The Board is of the opinion that such dryer vents and/or fireplace flues should be inspected and/or serviced a minimum of every three years by the unit owner in order to assure proper safety; and
NOW, THEREFORE, bit it resolved as follows:
1. Effective September 1997, each unit owner is required to provide to the Association, through Management, proof that the dryer vents and fireplace flues servicing its particular unit have been inspected and any necessary maintenance required to keep the dryer vents and/or fireplace flues in a safe and proper working condition has taken place; and
2. Each unit owner shall be required to present a copy of the bill for services rendered pursuant to the aforesaid inspection and/or maintenance from a reputable company in the business of cleaning and maintaining dryer vents and fireplace flues, which bill shall serve as evidence of the required inspection and maintenance; and
3. In the event that any unit owner fails to provide the necessary proof required, then the Association shall be authorized to hire a company to perform the necessary inspection and/or maintenance of the dryer vents and/or fireplace flues. Any such costs incurred by the Association pursuant to this provision shall be the sole responsibility of the unit owner; and
4. In the event that the unit owner fails to reimburse the Association for the expense incurred herein, pursuant to this Resolution, then the Association shall have the right to seek reimbursement for the same pursuant to all legal remedies available under the By-Laws and the Master Deed of the Association.
